Your agreement with OperTico

OperTico is provided by Guy Idan Bachar trading as OperTico, ABN 91 299 821 685, Australia ("we", "us"). By creating an account or using the service, you agree to these terms. If you act for a business, you must have authority to accept terms and take actions on its behalf. If you do not agree, do not use the service.

OperTico helps service businesses manage customers, jobs, teams, scheduling, documents, communications and supported integrations. Feature availability depends on your access, configuration, plan and provider availability. These terms do not promise that a proposed, preview or unavailable feature is currently operational.

Accounts and business access

You must be an adult able to enter an agreement, provide accurate account information, protect your credentials and comply with any verification requirements. Notify us promptly of suspected unauthorised access.

One personal account can own businesses and work as an employee or contractor for other businesses. Each business has separate memberships and permissions. A business administrator may invite users, grant or remove access, and configure business workflows. Access does not by itself establish employment, contractor status, legal ownership or authority to represent a company. You and the business remain responsible for those arrangements.

Only use information and functions you are authorised to access. Do not share credentials, impersonate another person, bypass access controls or use another business's data without permission.

Responsible use

Use OperTico lawfully. You are responsible for the accuracy of records and instructions you submit, rights to uploaded content, necessary notices and permissions, and compliance with obligations relevant to your business.

This includes tax and invoicing requirements, payment arrangements, employment and contractor obligations, marketing consent, call recording, messaging and worker or device location tracking. Do not send spam, upload harmful material, infringe others' rights, interfere with the service or use it for unlawful or deceptive activity.

OperTico supplies software. It does not become the employer, contracting party for your jobs, or your legal, tax or accounting adviser merely because you use it. Review calculations, documents, recipient details and other consequential output before approving them.

Your data and documents

You retain your rights in the information and content you provide. You authorise us and the providers needed for your chosen features to host, process, transmit and display it to operate and support those features, subject to the Privacy Policy. This permission does not give us ownership of your business records.

Business records may remain available to that business after a team member leaves. Issued documents, payment records and audit history can be retained or protected from alteration for recordkeeping and integrity. Archiving and deletion have different effects; review the information displayed before confirming an action. Contact us about access, export or deletion requests.

OperTico's software, design and branding remain ours or our licensors'. You may use them through the service for its intended purpose; these terms do not transfer ownership.

Connected services and AI

Connecting Google or another provider is optional and subject to its permissions, terms, verification and availability. Only connect accounts you are authorised to manage. Google API access approval for OperTico does not guarantee approval or verification of your individual business profile.

For Google Business Profile, choose the profile and OperTico location to connect. Publishing a review reply, photo or work post requires your explicit approval of the publication or the selected automation rules. You are responsible for the right and necessary permissions to publish work photos. Job-match suggestions are not proof of customer identity. Disconnecting locally removes the business's stored connection; choosing to revoke Google access can also affect other connections authorised by that Google account to the same OperTico Google project. Previously published Google content is not removed by disconnecting.

AI features may send relevant information to a provider to prepare drafts or recommendations. AI output may be incomplete or inaccurate. Check it before relying on it, sending it or publishing it. Feature-specific approval and automation controls determine what happens next.

Third-party services may change, reject requests or become unavailable. We cannot guarantee their decisions, publication timing, advertising results, search rankings, message delivery or payment approval. OperTico is an independent service; use of an integration does not imply endorsement by its provider.

Fees and payments

Any applicable subscription price, billing period, usage charge, tax and renewal or cancellation conditions must be presented when you purchase or activate the relevant paid service. Usage features such as phone, messaging, AI or payment processing may have separate charges and approval controls. Do not approve a charge unless you are authorised to do so.

These terms alone do not authorise an undisclosed fee or create a blanket no-refund rule. Refunds and cancellations follow the purchase terms and applicable law. Contact contact@opertico.com about billing errors or cancellation assistance.

Your customers' payments, team compensation and third-party processing arrangements remain subject to their separate agreements. OperTico records and workflows do not replace those agreements or guarantee that a payment will be completed.

Availability and changes

We maintain and develop the service, but do not promise uninterrupted or error-free availability. Maintenance, security incidents and provider outages can affect access. Keep copies of records needed for your own business continuity.

We may change features and these terms. We will publish updated terms with a new date and provide notice of material changes before they take effect where required. Changes will not remove accrued rights or mandatory legal protections. If you do not accept a material change, contact us about ending use and obtaining your records.

Ending use and suspension

You may stop using the service, disconnect integrations, or contact us about closing your account. Business owners can use available business deletion controls after reviewing their effect. Account closure, business deletion, ending a paid plan and revoking provider permissions are separate actions; contact us if you need help completing them.

We may restrict or suspend access where reasonably necessary to protect the service or users, comply with law, address a serious breach of these terms or handle unpaid agreed charges. Where practicable, we will explain the reason and allow an opportunity to resolve it, unless doing so would create a security risk or be legally prohibited.

Stopping use does not automatically erase records that must be retained. Data handling and requests after termination are described in the Privacy Policy.

Your rights and resolving issues

Nothing in these terms excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. This includes any applicable remedies for a service that does not meet a consumer guarantee. We do not impose a general waiver of those rights.

If something goes wrong, contact contact@opertico.com with the details so we can investigate and seek a resolution. You may use any complaint, regulator, court or other remedy available under applicable law. These terms do not require you to waive those options or use compulsory private arbitration.
